On 1 August 2024, the regulation on the development and use of artificial intelligence (AI) entered into force. We have written more about this here. Under the original timeline, the rules were scheduled to take effect gradually until August 2027. However, on 13 May 2026, the EU reached a provisional political agreement that postpones several deadlines and adjusts certain requirements. Among other things, the agreement includes:
· The rules and requirements for high-risk AI systems are postponed until 2 December 2027 (previously 2 August 2026). Examples include AI systems used by companies to screen job applicants or decide who should be promoted or terminated.
· The requirements for providers of general-purpose AI systems that can generate audio, images, video, or text to label AI-generated content created before 2 August 2026 are postponed until 2 December 2026 (previously 2 August 2026)
The political agreement must be formally adopted before these changes come into force.
iuno's opinion
The agreement does not change the deadline of 2 August 2026 for companies to label AI-generated or AI-manipulated image, audio, and video content. Companies that fail to comply may face fines of up to EUR 15 million or 3% of their total worldwide annual turnover, whichever is higher.
iuno recommends that companies identify the AI systems they use and assess each system's risk category. Most AI systems used for HR purposes are likely to be classified as high-risk. As a result, companies will need to comply with the new requirements from December 2027, depending on the specific system. In addition, companies should ensure that AI-generated or AI-manipulated image, audio, or video content is properly labelled from 2 August 2026.
