New rules to ensure responsible use of AI

The Danish Government has adopted new rules designating which authorities will monitor and enforce the EU Artificial Intelligence (AI) Regulation. The rules will enter into force on 2 August 2025.

Last year, the EU adopted a new regulation (the EU AI Act) governing the use of AI. You can read more about that here.

Under the new rules, the Danish Agency for Digital Government, the Data Protection Agency, and the Court Administration will be responsible for monitoring the prohibited use of AI by being able to:

  • Demand and collect all relevant and technical information about AI systems
  • Conduct on-site inspections and technical investigations of AI systems
  • Issue injunctions and temporary bans on the sale, marketing, and use of prohibited AI systems
  • Issue fines

The authorities can also publish their decisions regarding the prohibited use of AI.

IUNO's opinion

The rules are part of the EU's broader regulation of AI and, as something new, allow for the enforcement of the new AI rules. Companies must, therefore, be able to account for their use of AI and demonstrate how their systems work in the event of an inspection.

IUNO recommends that companies map their use of AI and assess which risk group their system falls under. They must also be able to explain how the system makes decisions and what data it uses. In addition to the new rules, AI systems must continue to comply with general discrimination and data protection rules.
